These Terms and Conditions ("Terms") govern your use of this website and the enquiry, business verification and fuel-related services made available through it (the "Service"). By using the website, submitting an enquiry or providing information through the Service, you agree to be bound by these Terms.
The Service is provided by Driving Down Ltd, with registered/contact address at Priestley House, 170 Elland Road, Leeds, LS11 8BU ("we", "us" or "our"). Adstrategy Global, Lda. provides technical, marketing and data-processing support in connection with the operation of the website.
The website allows users to submit information about their business and fuel requirements so that we can assess their circumstances, contact them and provide or arrange information about suitable commercial fuel-related products or services.
Depending on the answers provided, the Service may request information such as business type, fuel-card usage, estimated monthly fuel spend, trading history, contact details, company information and, where applicable, a recent fuel-card invoice.
Submission of an enquiry does not guarantee that any particular product, saving, commercial offer or service will be available to you. Any quotation, proposal, estimate or recommendation may be subject to further checks, eligibility criteria, contractual terms and information supplied by the relevant provider.
You agree that the information you provide through the Service will, to the best of your knowledge, be accurate, complete and up to date. You must not knowingly submit false, misleading, fraudulent or unauthorised information.
Where you submit information on behalf of a company, partnership or other organisation, you confirm that you are authorised to provide that information and to make the enquiry on its behalf.
You are responsible for checking information automatically completed or returned by the Service and for notifying us if you believe any information is incorrect.
Where you provide a UK VAT registration number, we may verify that VAT number using HM Revenue & Customs' ("HMRC") Check a UK VAT Number service. Depending on the version of the Service being used, this verification may be carried out either directly with HMRC or through the third-party VAT validation service Avatcado.
Avatcado is a VAT and GST validation service operated by De Jongh Software Development (KVK 84251352) in the Netherlands. For UK VAT-number checks, Avatcado queries HMRC and returns the validation result and available company details to our server.
The purpose of this check is to carry out business due diligence, confirm that the VAT number is registered, verify the identity of the associated business and reduce inaccurate or fraudulent business submissions.
Where the check is performed directly with HMRC, the VAT registration number is transmitted from our server to HMRC. Where Avatcado is used, the VAT registration number is transmitted from our server to Avatcado and then submitted to HMRC for validation. HMRC may return information associated with the VAT registration, including the registered business name and related registration details. The Service may use the registered business name returned from the verification to verify or automatically complete the Company Name field.
Information such as your personal name, email address, telephone number, postal code and uploaded fuel-card invoice is not sent to HMRC or Avatcado as part of the VAT-number lookup.
You are not required to provide us with HMRC or Avatcado sign-in credentials. We do not request, collect or store your HMRC or Avatcado username or password for this VAT verification.
Where Avatcado is used, its handling of API and validation information is subject to its own privacy policy. Avatcado states that it logs API usage information including the VAT number queried, endpoint called, API-key identifier, response status and timestamp.
HMRC provides the underlying UK VAT verification registry as a third-party public authority. Avatcado is an independent third-party technology provider and is not a tax authority. Use of either service does not mean that HMRC or Avatcado approves, endorses, accredits, certifies or recommends this website, our business or the services offered through it.
A successful VAT-number check confirms only the information returned by the relevant verification service for the VAT number at the time of the check. It does not constitute a credit check, financial assessment, guarantee of solvency, guarantee of trading status or endorsement of the business concerned.
Where the Service allows you to upload a fuel-card invoice or other supporting document, you confirm that you are entitled to provide that document and the information contained in it.
Uploaded documents may be used to assess your current fuel arrangements, understand relevant pricing or usage information and identify potential commercial opportunities or savings.
You must not upload documents containing information that is unlawful, malicious, irrelevant to the enquiry or that you are not authorised to disclose.
By submitting an enquiry, you ask us to contact you using the contact details you provide in order to respond to your request, discuss your business requirements and provide information relating to relevant products or services.
Where separate consent is required for direct marketing, marketing communications will only be sent in accordance with the preferences and permissions you have provided and applicable law. You may withdraw marketing consent at any time using the unsubscribe method provided or by contacting us.
Personal data submitted through the Service is processed in accordance with our Privacy Policy and applicable data-protection legislation, including the UK GDPR and, where applicable, the EU General Data Protection Regulation.
Our Privacy Policy explains what information we collect, the purposes and lawful bases for processing it, how information may be shared, how long it is retained and the rights available to individuals.
Where Avatcado is used for VAT verification, Avatcado processes API and validation information under its own privacy policy, available at https://www.avatcado.com/privacy.
Where a UK VAT registration number is provided, the VAT number may be shared directly with HMRC or with Avatcado, which submits UK VAT numbers to HMRC, for the business verification and due-diligence purposes described in these Terms and in our Privacy Policy.
The Service may rely on third-party systems, service providers, public authorities and APIs, including HMRC and Avatcado. Those services may occasionally be unavailable, delayed, changed or interrupted for reasons outside our reasonable control.
We do not guarantee continuous or uninterrupted availability of any third-party service. Where an external verification service is temporarily unavailable, we may be unable to verify submitted information immediately and may ask you to try again later or provide additional information.
Any savings, percentages, examples, comparisons or commercial illustrations displayed on the website are indicative only unless expressly stated otherwise. Actual results depend on individual circumstances, supplier terms, fuel usage, market conditions and other relevant factors.
We do not guarantee that you will be accepted by any provider, obtain a particular price or achieve a particular level of saving.
